A lacerated liver that a Hamilton motorcyclist suffered in a crash before being arrested does not the threshold for the SIU to investigate, meaning a local police officer has been cleared.

The Ontario Special Investigations Unit says it has terminated an investigation into a motorcycle collision that occurred three weeks ago in downtown Hamilton. On June 12, three weeks ago Monday, a 32-year-old man was, per the SIU, “unlawfully operating a motorcycle,” which was tracked by a Hamilton Police officer.

The officer followed the motorcylist, who accelerated on Victoria Ave. N. and on Barton St. E.. The motorcyclist lost control and crashed near Oak Street, where he was thrown off the bike. The officer prevented him from getting back on the bike and arrested him.

The man was diagnosed with a lacerated liver at a hospital, but did not need treatment or hospital admission.

“The man did not suffer a ‘serious injury’ within the terms of the SIU’s mandate,” a release stated. “As the SIU was without statutory jurisdiction to investigate the matter, the file has been closed.”

The SIU invokes its mandate when a person in Ontario is injured or dies after an interaction with police.
