A driver, who Niagara Police have now charged with impaired, took off through a Pelham intersection after officers woke him up and ordered him out of the car.

The police were called to the Victoria Ave. and Webber Rd area on March 22 at 10:45 pm when citizens saw the driver sleeping behind the wheel of a grey 2005 Acura EL while still on the road.

When officers woke the driver, he refused to get of the car and suddenly took off from the scene, narrowly missing hitting the officers and other cars in the area. Out of a concern for public safety, the police didn’t chase him at first.

However, because the calls continued to come in from the public about the Acura being driven erratically, the police found him again, this time stopped at the intersection of Victoria Ave. and Canboro Rd.  They were quickly able to box him in with their cruisers.

Despite being told he was under arrest, the driver still refused to get out of the car. There was a brief struggle between the driver and the officers and arrested at 11:20 pm.

Police says he showed signs of being impaired and that empty beer cans littered the front seat.

Cole Wesley Deboer, 25, of Wainfleet has been charged with dangerous driving, flight from the police, resisting arrest, impaired driving and impaired operation of a vehicle over 80 mgs.

Deboer was released from custody with a court date coming while his car was impounded. He was given an automatic 90 day licence suspension, pending further possible convictions in court.
