Milton murder suspect ‘only defending his mother’ according to defence lawyer

The lawyer for a Milton man charged with murder said his client was only defending his mother.

Toronto lawyer Jag Virk, who also has offices in Hamilton, Brampton and Burlington, released the statement following the weekend incident in Milton that saw one man dead, one alleged robber arrested, and three still at large.

“My 22-year-old client, who lives at that home with his single mother, shot at an intruder who broke into his home and attacked his mother,” said Virk about Ali Mian, who is facing a second-degree murder charge.

“He is a registered firearm owner and used his gun legally against an armed intruder. He shouldn’t be charged with murder for protecting his mother from someone who broke into his home. His intention was not to kill the intruder, he only shot at him once. We are all saddened the intruder passed away as a result of being shot.”

Halton police have not released the name of the deceased intruder.

The shooting took place around 5 a.m. Sunday morning on Gibson Cres., near Ontario St. S. and Louis St. Laurent Ave.

Romario Clarke, 20, was arrested when officers arrived at the scene. He has been charged with one count of break and enter and unauthorized possession of a firearm.

Police are searching for the three suspects who fled in a white or light-coloured Dodge Charger with a sunroof and black wheels.
