Fort Erie man who evades police in vehicle caught, now facing drug charges

A Fort Erie man who evaded police in the early morning hours of Tuesday (July 2) when he sped away in his vehicle was later located and arrested, and is now facing drug charges.

Niagara Regional Police spotted a 2011 BMW sedan on Ferry Street near Main Street in Niagara Falls at 1:35 a.m. and looked to pull the vehicle over with the assistance of fellow officers on Lundy’s Lane near Drummond Road.

It is alleged the drive failed to stop and accelerated away at a high rate of speed. With the identity of the driver known, police decided not to pursue the vehicle for “public safety” reasons and an arrest was sought instead.

The driver would be located later in the day at 3:25 p.m. in a parking lot near Forsythe Street and Niagara Boulevard in Fort Erie. With assistance from the canine unit, the man was placed under arrest.

A search of the man and vehicle would result in the alleged seizure of 71.3 grams of suspected cocaine and $500 in Canadian currency police believe had been acquired through the “proceeds of crime.”

James Maxwell, 41, of Fort Erie has been charged with:

  • Flight from peace officer
  • Possession of proceeds of property obtained by crime under $5,000
  • Possession of cocaine for the purpose of trafficking
  • Two counts of fail to comply with a release order

Maxwell remains in police custody and was scheduled to attend a bail hearing in St. Catharines on Wednesday (July 3).
