Court Dismisses Class Action Lawsuit Against Beer Store

A  class action lawsuit launched against the Beer Store three years ago has been dismissed by the Ontario Superior Court of Justice.

“We have always believed this case was completely without merit and now the court has agreed,” said Beer Store board chairperson Charlie Angelakos on Monday.

“The case was filled with factual errors and fundamentally misunderstood the way alcohol products are sold in Ontario.”

The $1.4 billion lawsuit was filed in January 2015 and alleged “that as a result of an agreement to allocate the market for the supply of beer in Ontario between the Liquor Control Board of Ontario and the Beer Store, consumers and licencees (restaurant owners) who purchased beer in Ontario were overcharged for their purchases.”

Regulations fall under the Liquor Control Act and the sale of alcohol has always been overseen by the province.

The Beer Store says it “has always operated according to the rules established by the province for the regulation, sale and distribution of beer, and continues to do so today.”

The plaintiffs have 30 days to file an appeal.
